Landlords – your electrical safety obligation.
Landlords may be exposing themselves to significant financial risks, from fines and invalidated insurance, through not acting on their electrical safety obligations.
Landlords are required by law to ensure:
That the electrical installation in a rented property is safe when tenants move in and is maintained in a safe condition throughout its duration.Â
That a House in Multiple Occupation (HMO) has a periodic inspection carried out on the property every five years. If your property is not an HMO, you are not legally obliged to do this. However, we recommend that a periodic inspection and test is carried out by a registered electrician on your rental properties at least every five years. That any appliance provided is safe and has at least the CE marking (which is the manufacturer’s claim that it meets all the requirements of European law).Â
To meet these requirements a landlord will need to regularly carry out basic safety checks to ensure that the electrical installation and appliances are safe and working.
The Electrical Safety Standards in the
Private Rented Sector (England)
Regulations 2020
The Ministry for Housing, Communities and Local Government (MHCLG) has introduced legislation for landlords in England to make it a mandatory requirement to have electrical safety checks carried out in their properties.
These electrical safety checks are to be carried out at intervals of no more than 5 years by a qualified and competent person.
This new legislation comes into force on 1st June 2020 for Landlords in England for electrical safety checks to be completed on their properties following the timeline below-
(a) all new specified tenancies from 1st July 2020; and
(b) all existing specified tenancies from 1st April 2021.
